The proposed bill aims to prohibit the sale of disposable vapor products in Arkansas by amending the Arkansas Tobacco Products Tax Act of 1977. It introduces a new definition for "disposable vapor product," which is characterized as a vapor product with a non-detachable battery, that cannot be refilled with e-liquid, and is intended for disposal after use. The bill establishes a new section that explicitly prohibits any person or entity from selling or offering disposable vapor products for retail sale in the state. Violations of this prohibition are classified as a Class A misdemeanor, and the Director of Arkansas Tobacco Control is granted the authority to seize and hold any such products sold in violation of this law.

Additionally, the bill includes temporary provisions requiring the Director of Arkansas Tobacco Control to inform manufacturers, wholesalers, retailers, and vendors about the new requirements and the compliance timeline. A grace period of ninety days is provided for these entities to liquidate, sell, or dispose of any disposable vapor products they currently possess. Notably, the prohibition does not apply to products that have received approval from the United States Food and Drug Administration.
