The proposed bill, titled the "Genetic Testing Act," aims to establish coverage for genetic testing related to inherited cancer mutations in Arkansas. It introduces a new subchapter to the Arkansas Code, specifically under Title 23, Chapter 79, which outlines definitions pertinent to the act, including terms such as "clinical genetic testing for an inherited cancer mutation," "cost-sharing requirements," and "health benefit plan." The act mandates that, starting January 1, 2026, health benefit plans offered in the state must cover clinical genetic testing for individuals with a personal or family history of cancer, as well as evidence-based cancer imaging for those at increased risk of cancer, as recommended by healthcare professionals and aligned with established clinical practice guidelines.

Additionally, the bill includes provisions regarding health savings accounts, stating that if the application of the coverage would lead to ineligibility for health savings accounts under federal guidelines, the coverage will only apply to qualified high deductible health plans after the minimum deductible is met. The Insurance Commissioner is also granted the authority to develop rules for the implementation and administration of this new subchapter.
