This bill proposes an enhanced sentencing framework for individuals convicted of raping a child aged twelve years or younger. It introduces a new section to the Arkansas Code that mandates chemical castration through medroxyprogesterone acetate treatment for such offenders, to be administered by the Department of Corrections under the supervision of a licensed physician. The court's order for this treatment is contingent upon a medical expert's assessment that the defendant is a suitable candidate, with a determination required within sixty days of sentencing. The court will also specify the duration of the treatment, which can extend up to the defendant's lifetime.
Additionally, the bill allows for the possibility of physical castration as an alternative to chemical treatment, provided the defendant consents in writing. It establishes that if a defendant fails to attend or refuses the prescribed treatment, they will be guilty of a Class Y felony. The Department of Corrections is tasked with administering and monitoring the treatment, which must begin no later than one week before the defendant's release from incarceration.
