The bill mandates that any digital asset mining business currently operating within this radius must shut down unless it was fully constructed and operational before December 31, 2024. Additionally, if ownership of such a business changes, it must cease operations at those locations before the change takes effect.
The bill also grants the Attorney General the authority to investigate potential violations of this prohibition, including the ability to receive sworn statements and issue subpoenas. If a violation is confirmed, the Attorney General can order the business to shut down operations within the restricted area. An emergency clause is included, stating that the act is necessary for the health and safety of Arkansas citizens due to the risks posed by digital asset mining near military facilities. The act will take effect immediately upon approval by the Governor or under specified conditions if not vetoed.
