The bill amends the Arkansas Data Centers Act of 2023 to prohibit digital asset mining businesses from operating within a thirty-mile radius of military facilities. It defines a "military facility" as any location operated by the U.S. Armed Forces or National Guard that houses personnel and equipment, supports training, or serves as a command center. The legislation mandates that any digital asset mining business must cease operations at locations within this radius unless they were fully constructed and operational before December 31, 2024. Additionally, if a business changes ownership, it must shut down operations at such locations before the ownership change takes effect.
The bill also empowers the Attorney General to investigate potential violations of this prohibition, which may include receiving sworn statements and issuing subpoenas for testimony and documents. If a violation is confirmed, the Attorney General can order the business to shut down operations at the offending locations. An emergency clause is included, stating that the act is necessary to protect the health and safety of Arkansas citizens due to the risks associated with digital asset mining near military facilities. The act will take effect immediately upon approval by the Governor or under specified conditions if not vetoed.
