The "Make Arkansas Healthy Again Act" aims to enhance food safety by prohibiting the manufacturing, selling, delivering, distributing, holding, or offering for sale any food product for human consumption that contains specific harmful substances. The bill identifies potassium bromate and propylparaben as prohibited substances, which are known to pose health risks. Violators of this law may face civil penalties, with fines reaching up to $5,000 for a first offense and up to $10,000 for subsequent violations.

This legislation will be codified as a new section in the Arkansas Code, specifically under Title 20, Chapter 57, Subchapter 4, and will take effect on January 1, 2028. The enforcement of this act will be the responsibility of the Attorney General, city attorneys, county attorneys, or prosecuting attorneys, who can initiate actions against violators.
