The "Make Arkansas Healthy Again Act" aims to enhance food safety by prohibiting the manufacturing, selling, delivering, distributing, holding, or offering for sale any food product for human consumption that contains specific harmful substances. The bill identifies potassium bromate and propylparaben as prohibited substances, which are known to pose health risks. This new regulation will be codified in Arkansas Code Title 20, Chapter 57, Subchapter 4, under a newly added section, 20-57-403.
Violators of this act may face civil penalties, with fines reaching up to $5,000 for a first offense and up to $10,000 for subsequent violations, enforceable by the Attorney General or local prosecuting attorneys. The act is set to take effect on January 1, 2028, allowing time for compliance and awareness among manufacturers and sellers in the state.
