10 ARKANSAS VOTERS TO OPPOSE THE "EDUCATIONAL RIGHTS
11 AMENDMENT OF 2024".

16 "EDUCATIONAL RIGHTS AMENDMENT OF 2024"
17 AND ENCOURAGE ALL REGISTERED ARKANSAS
18 VOTERS TO OPPOSE THE "EDUCATIONAL RIGHTS
19 AMENDMENT OF 2024."

22 WHEREAS, Arkansas became a national leader in education reform in 2023
23 with the passage of the LEARNS Act; and
24
25 WHEREAS, the LEARNS Act provided historic increases in teacher pay and
26 investments in public education including literacy coaches, tutoring grants,
27 and pre-K; and
28
29 WHEREAS, the LEARNS Act created universal education freedom in both
30 private and public schools; and
31
32 WHEREAS, thousands of Arkansas families, many of whom have children
33 with disabilities, are now participating in the LEARNS Act’s Education
34 Freedom Account Program; and
35
36 WHEREAS, religious liberty is a fundamental cornerstone of the American

1 and Arkansas way of life; and

3 WHEREAS, Arkansas has made significant strides in providing tax relief
4 to hardworking Arkansans; and
5
6 WHEREAS, Arkansans currently have more educational rights than at any
7 time in our state’s history; and
8
9 WHEREAS, the “Educational Rights Amendment of 2024” includes no cost
10 projections or pay-for mechanisms and will certainly cost at least $1 billion
11 dollars ($1,000,000,000) per year, according to conservative estimates; and
12
13 WHEREAS, the “Educational Rights Amendment of 2024” would create
14 multiple new welfare programs that would become constitutional rights and
15 include no work requirements, time limits, or income restrictions whatsoever,
16 allowing the richest Arkansans to take resources from hard working taxpayers;
17 and
18
19 WHEREAS, the “Educational Rights Amendment of 2024” would require tax
20 increases and reverse much of the progress the General Assembly has made on
21 tax reform, even this very week; and
22
23 WHEREAS, the “Educational Rights Amendment of 2024” would jeopardize
24 teacher pay raises; and
25
26 WHEREAS, the “Educational Rights Amendment of 2024” would impose
27 extreme regulations on private schools which are designed to push them out of
28 the Education Freedom program entirely; and
29
30 WHEREAS, the “Educational Rights Amendment of 2024” would impose
31 unconstitutional violations of religious liberty by requiring private schools
32 to violate their religious beliefs and prohibit them from teaching religious
33 subjects entirely; and
34
35 WHEREAS, the “Educational Rights Amendment of 2024” would reopen the
36 door to indoctrination and extreme ideologies such as Critical Race Theory

1 into Arkansas schools; and

3 WHEREAS, the above mentioned policies would be cemented into the state
4 constitution and would handcuff future General Assemblies; and
5
6 WHEREAS, the “Educational Rights Amendment of 2024” would rip critical
7 funding away from Arkansas families and special needs students,
8
9 NOW THEREFORE,
10 BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES OF THE NINETY-FOURTH GENERAL
11 ASSEMBLY OF THE STATE OF ARKANSAS:
12
13 THAT the House of Representatives oppose the misleadingly titled
14 "Educational Rights Amendment of 2024" and encourage all registered Arkansas
15 voters to oppose it.
