18 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

20 SECTION 1. REAPPROPRIATION - CAPITAL IMPROVEMENT PROJECTS. There is
21 hereby appropriated, to the Department of the Military, to be payable from
22 the Development and Enhancement Fund, for the Department of the Military the
23 following:
24 (A) Effective July 1, 2024, the balance of the appropriation provided
25 in Item (A) of Section 1 of Act 229 of 2023, for construction of a Readiness
26 Center Joint Force Headquarters at Camp Joseph T. Robinson, in a sum not to
27 exceed ...........................................................$2,225,775.

29 SECTION 2. REAPPROPRIATION - FEDERAL CAPITAL PROJECTS. There is hereby
30 appropriated, to the Department of the Military, to be payable from the
31 federal funds as designated by the Chief Fiscal Officer of the State, for the
32 Department of the Military the following:
33 (A) Effective July 1, 2024, the balance of the appropriation provided
34 in Item (A) of Section 2 of Act 229 of 2023, for repair, construction,
35 renovation, expansion, landscaping, maintenance, improvement, or equipping of
36 the Professional Education Center (PEC) at Camp Joseph T. Robinson, in a sum

1 not to exceed ....................................................$6,500,000.
2 (B) Effective July 1, 2024, the balance of the appropriation provided
3 in Item (B) of Section 2 of Act 229 of 2023, for construction of a Readiness
4 Center Joint Force Headquarters at Fort Chaffee, in a sum not to exceed
5 ..................................................................$5,117,313.
6 (C) Effective July 1, 2024, the balance of the appropriation provided
7 in Item (C) of Section 2 of Act 229 of 2023, for a Multi-Purpose Machinegun
8 Range at Camp Joseph T. Robinson, in a sum not to exceed ........$11,499,000.
9 (D) Effective July 1, 2024, the balance of the appropriation provided
10 in Item (D) of Section 2 of Act 229 of 2023, for an RMTC Redundant Water
11 Storage Tank at Camp Joseph T. Robinson, in a sum not to exceed
12 ..................................................................$6,840,000.
13 (E) Effective July 1, 2024, the balance of the appropriation provided
14 in Item (F) of Section 2 of Act 229 of 2023, for construction of a Readiness
15 Center Joint Force Headquarters at Camp Joseph T. Robinson, in a sum not to
16 exceed ...........................................................$6,677,325.
17 (F) Effective July 1, 2024, the balance of the appropriation provided
18 in Item (B) of Section 1 of Act 218 of 2023, for a Multi-Purpose Machinegun
19 Range at Camp Joseph T. Robinson, in a sum not to exceed .........$8,000,000.
20 (G) Effective July 1, 2024, the balance of the appropriation provided
21 in Item (E) of Section 1 of Act 218 of 2023, for construction of a Readiness
22 Center at Fort Chaffee, in a sum not to exceed ..................$12,747,217.

24 SECTION 3. REAPPROPRIATION - ARMORY CONSTRUCTION FUND CAPITAL PROJECTS.
25 There is hereby appropriated, to the Department of the Military, to be
26 payable from the Armory Construction Fund, for the Department of the Military
27 the following:
28 (A) Effective July 1, 2024, the balance of the appropriation provided
29 in Item (A) of Section 2 of Act 218 of 2023, for repair, construction,
30 renovation, landscaping and maintenance of armories, hangars, and other
31 properties held for the use and benefit of the Arkansas National Guard, in a
32 sum not to exceed ................................................$1,849,784.

34 SECTION 4. DISBURSEMENT CONTROLS. (A) No contract may be awarded nor
35 obligations otherwise incurred in relation to the project or projects
36 described herein in excess of the State Treasury funds actually available

1 therefor as provided by law. Provided, however, that institutions and
2 agencies listed herein shall have the authority to accept and use grants and
3 donations including Federal funds, and to use its unobligated cash income or
4 funds, or both available to it, for the purpose of supplementing the State
5 Treasury funds for financing the entire costs of the project or projects
6 enumerated herein. Provided further, that the appropriations and funds
7 otherwise provided by the General Assembly for Maintenance and General
8 Operations of the agency or institutions receiving appropriation herein shall
9 not be used for any of the purposes as appropriated in this act.
10 (B) The restrictions of any applicable provisions of the State
11 Purchasing Law, the General Accounting and Budgetary Procedures Law, the
12 Revenue Stabilization Law and any other applicable fiscal control laws of
13 this State and regulations promulgated by the Department of Finance and
14 Administration, as authorized by law, shall be strictly complied with in
15 disbursement of any funds provided by this act unless specifically provided
16 otherwise by law.

18 SECTION 5. LEGISLATIVE INTENT. It is the intent of the General
19 Assembly that any funds disbursed under the authority of the appropriations
20 contained in this act shall be in compliance with the stated reasons for
21 which this act was adopted, as evidenced by the Agency Requests, Executive
22 Recommendations and Legislative Recommendations contained in the budget
23 manuals prepared by the Department of Finance and Administration, letters, or
24 summarized oral testimony in the official minutes of the Arkansas Legislative
25 Council or Joint Budget Committee which relate to its passage and adoption.

27 SECTION 6. EMERGENCY CLAUSE. It is found and determined by the General
28 Assembly, that the Constitution of the State of Arkansas prohibits the
29 appropriation of funds for more than a one (1) year period; that the
30 effectiveness of this Act on July 1, 2024 is essential to the operation of
31 the agency for which the appropriations in this Act are provided, and that in
32 the event of an extension of the legislative session, the delay in the
33 effective date of this Act beyond July 1, 2024 could work irreparable harm
34 upon the proper administration and provision of essential governmental
35 programs. Therefore, an emergency is hereby declared to exist and this Act
36 being necessary for the immediate preservation of the public peace, health
