25 BE IT RESOLVED BY THE SENATE OF THE NINETY-FOURTH GENERAL ASSEMBLY OF THE
26 STATE OF ARKANSAS:

28 THAT Senator King is authorized to introduce a bill which as introduced
29 will read substantially as follows:

32 AN ACT TO AMEND THE ARKANSAS DATA CENTERS ACT OF 2023; TO REQUIRE A DIGITAL
33 ASSET MINER OR DIGITAL ASSET MINING BUSINESS TO PROVIDE NOTIFICATION BEFORE
34 PURCHASING OR LEASING LAND OR A BUILDING OR BEGINNING CONSTRUCTION OF A

4 PURCHASING OR LEASING LAND OR A BUILDING OR BEGINNING CONSTRUCTION.

6 SECTION 1. Arkansas Code Title 14, Chapter 1, Subchapter 6, is amended
7 to add an additional section to read as follows:
8 14-1-606. Purchase of land for or construction of facility for digital
9 asset mining or utilization of blockchain network — Notification —
10 Definition.
11 (a) A digital asset miner, digital asset mining business, or business
12 utilizing a blockchain network that is seeking to purchase or lease land or a
13 building for the operating of digital asset mining or utilization of a
14 blockchain network, shall file a written notification with the Arkansas
15 Public Service Commission and the local government of the area where the
16 purchase, leasing, or construction is anticipated to occur no fewer than six
17 (6) months before:
18 (1) The purchase or leasing occurs, if no purchase or leasing
19 has occurred before the enactment of this act; or
20 (2) Construction starts, if a purchase has been made or leasing
21 has occurred before the enactment of this act.
22 (b) As used in this section, "construction" includes any sitework to
23 clear or prepare land for building.”
