4 SECTION 2. EXTRA HELP. There is hereby authorized, for the Department
5 of Transformation and Shared Services - Division of Information Systems for
6 the 2024-2025 fiscal year, the following maximum number of part-time or
7 temporary employees, to be known as "Extra Help", payable from funds
8 appropriated herein for such purposes: eighteen (18) temporary or part-time
9 employees, when needed, at rates of pay not to exceed those provided in the
10 Uniform Classification and Compensation Act, or its successor, or this act
11 for the appropriate classification.

13 SECTION 3. APPROPRIATION - OPERATIONS. There is hereby appropriated,
14 to the Department of Transformation and Shared Services, to be payable from
15 the Division of Information Systems Revolving Fund, for personal services and
16 operating expenses of the Department of Transformation and Shared Services -
17 Division of Information Systems for the fiscal year ending June 30, 2025, the

36 SECTION 4. APPROPRIATION - EQUIPMENT ACQUISITIONS AND INFORMATION

1 TECHNOLOGY IMPROVEMENTS. There is hereby appropriated, to the Department of
2 Transformation and Shared Services, to be payable from the Information
3 Technology Reserve Fund, for major equipment acquisitions and information
4 technology improvements, as set out in Arkansas Code §25-4-122 and §25-4-123
5 by the Department of Transformation and Shared Services - Division of
6 Information Systems for the fiscal year ending June 30, 2025, the following:

13 SECTION 5. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS
14 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW.
15 COMPLIANCE WITH STATE AND FEDERAL REGULATIONS.
16 1. In order to effect compliance with the requirements of state and federal
17 statutory and regulatory provisions, the Director shall adjust billing rates
18 or issue billing adjustments to be federally compliant, notwithstanding the
19 provisions of ACA §25-4-105 and §25-4-119 or funds sufficient to effect
20 compliance shall be provided the Division from General Revenues, Special
21 Revenues or such other fund sources as may become available. These actions
22 shall be subject to the approval of the Chief Fiscal Officer of the State and
23 approval by the Arkansas Legislative Council or Joint Budget Committee.
24 2. The Director shall have authority to transfer funds between the
25 Information Technology Reserve Fund established by ACA §25-4-123 and the
26 Division of Information Systems Revolving Fund established by ACA §25-4-121
27 for cash management purposes.
28 Determining the maximum number of employees and the maximum amount of
29 appropriation and general revenue funding for a state agency each fiscal year
30 is the prerogative of the General Assembly. This is usually accomplished by
31 delineating such maximums in the appropriation act(s) for a state agency and
32 the general revenue allocations authorized for each fund and fund account by
33 amendment to the Revenue Stabilization law. Further, the General Assembly
34 has determined that the Division of Information Systems may operate more
35 efficiently if some flexibility is provided to the Division of Information
36 Systems authorizing broad powers under this section. Therefore, it is both

1 necessary and appropriate that the General Assembly maintain oversight by
2 requiring prior approval of the Legislative Council or Joint Budget Committee
3 as provided by this section. The requirement of approval by the Legislative
4 Council or Joint Budget Committee is not a severable part of this section.
5 If the requirement of approval by the Legislative Council or Joint Budget
6 Committee is ruled unconstitutional by a court of competent jurisdiction,
7 this entire section is void.
8 The provisions of this section shall be in effect only from July 1, 2023
9 2024 through June 30, 2024 2025.

11 SECTION 6. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS
12 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. TRANSFER
13 PROVISION - LINE ITEMS - DIVISION OF INFORMATION SYSTEMS - OPERATIONS. After
14 receiving approval from the Chief Fiscal Officer of the State and prior
15 review by the Arkansas Legislative Council or Joint Budget Committee, the
16 Secretary of the Department of Transformation and Shared Services is
17 authorized to transfer appropriation between the line items authorized herein
18 for the Division of Information Systems - Operations to best utilize
19 resources to respond to the needs of the Division's customers.
20 The provisions of this section shall be in effect only from July 1, 2023
21 2024 through June 30, 2024 2025.

23 SECTION 7. COMPLIANCE WITH OTHER LAWS. Disbursement of funds
24 authorized by this act shall be limited to the appropriation for such agency
25 and funds made available by law for the support of such appropriations; and
26 the restrictions of the State Procurement Law, the General Accounting and
27 Budgetary Procedures Law, the Revenue Stabilization Law, the Regular Salary
28 Procedures and Restrictions Act, or their successors, and other fiscal
29 control laws of this State, where applicable, and regulations promulgated by
30 the Department of Finance and Administration, as authorized by law, shall be
31 strictly complied with in disbursement of said funds.

33 SECTION 8. LEGISLATIVE INTENT. It is the intent of the General
34 Assembly that any funds disbursed under the authority of the appropriations
35 contained in this act shall be in compliance with the stated reasons for
36 which this act was adopted, as evidenced by the Agency Requests, Executive

1 Recommendations and Legislative Recommendations contained in the budget
2 manuals prepared by the Department of Finance and Administration, letters, or
3 summarized oral testimony in the official minutes of the Arkansas Legislative
4 Council or Joint Budget Committee which relate to its passage and adoption.

6 SECTION 9. EMERGENCY CLAUSE. It is found and determined by the General
7 Assembly, that the Constitution of the State of Arkansas prohibits the
8 appropriation of funds for more than a one (1) year period; that the
9 effectiveness of this Act on July 1, 2024 is essential to the operation of
10 the agency for which the appropriations in this Act are provided, and that in
11 the event of an extension of the legislative session, the delay in the
12 effective date of this Act beyond July 1, 2024 could work irreparable harm
13 upon the proper administration and provision of essential governmental
14 programs. Therefore, an emergency is hereby declared to exist and this Act
15 being necessary for the immediate preservation of the public peace, health
16 and safety shall be in full force and effect from and after July 1, 2024.
