18 OF THE ARKANSAS PUBLIC SERVICE COMMISSION
19 OVER INTERSTATE RATES, CHARGES,
20 CLASSIFICATIONS, AND OTHER ACTIONS; AND
21 TO INCREASE THE AMOUNT RECOVERABLE FROM
22 AN AFFECTED UTILITY.

25 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

27 SECTION 1. Arkansas Code ยง 23-4-102(c)(3)(A), concerning the maximum
28 amount allowed for direct recovery by the Arkansas Public Service Commission,
29 is amended to read as follows:
30 (3)(A)(i) May adopt rules for direct recovery of the fees and
31 expenses of contract attorneys and consultants from the affected utility
32 under this section, provided that the utility is an electric public utility
33 that is owned by a public utility holding company as defined by section 1262
34 of the Energy Policy Act of 2005, Pub. L. No. 109-58.
35 (ii) The maximum amount that may be directly
36 recovered from an affected utility shall be three million dollars

1 ($3,000,000) annually five million dollars ($5,000,000) per calendar year.
