23 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

25 SECTION 1. Arkansas Code § 17-19-106 is amended to read as follows:
26 17-19-106. Professional Bail Bond Company and Professional Bail
27 Bondsman Licensing Board.
28 (a) This section may be cited as the “Arkansas Professional Bail Bond
29 Company and Professional Bail Bondsman Licensing Act”.
30 (b)(1) There is hereby created the Professional Bail Bond Company and
31 Professional Bail Bondsman Licensing Board.
32 (2)(A) The board shall be composed of seven (7) five (5) members
33 to be appointed by the Governor for terms of seven (7) five (5) years.
34 (B) Vacancies shall be filled by appointment of the
35 Governor for the unexpired portion of the term.
36 (3)(A) Three (3) members of the board shall be licensed bail

1 bond company owners, one (1) a current or former municipal chief of police,
2 one (1) a current or former county sheriff, and two (2) shall be residents of
3 the state who are not a bail bond company owner, a sheriff, or a chief of
4 police.
5 (B)(i) Each congressional district shall be represented by
6 at least one (1) member of the board.
7 (ii) At least one (1) board member shall be an
8 African-American.
9 (iii) At least one (1) board member shall be a
10 female.
11 (4) The board shall have the authority and responsibility to
12 administer and enforce the provisions of this chapter relating to licensing
13 and regulation of professional bail bond companies and professional bail
14 bondsmen.
15 (5)(4) The board shall have the authority to adopt and enforce
16 such reasonable rules as it determines to be necessary to enable it to
17 effectively and efficiently carry out its official duty of licensing and
18 regulating professional bail bond companies and professional bail bondsmen.
19 (c) The members of the board shall receive expense reimbursement in
20 accordance with § 25-16-901 et seq., and a stipend pursuant to under § 25-16-
21 904.
22 (d) The provisions of this section shall not be construed to repeal
23 any laws in effect on August 13, 1993, relating to the licensing and
24 regulation of professional bail bond companies and professional bail bondsmen
25 but such laws shall remain in full force and effect and shall be administered
26 by the board created herein under this section.

28 SECTION 2. DO NOT CODIFY. Expiration of terms of current membership
29 of the Professional Bail Bond Company and Professional Bail Bondsman
30 Licensing Board.
31 (a) The current membership of the Professional Bail Bond Company and
32 Professional Bail Bondsman Licensing Board shall be dissolved upon the
33 effective date of this act.
34 (b) The Governor shall appoint members to the board as described under
35 this act.
36 (c)(1) The initial appointments of the members shall draw lots for

1 terms of one (1), two (2), three (3), four (4), or five (5) years.
2 (2) An initial term of less than five (5) years shall not count
3 against reappointment.
