21 DUTIES OF THE ARKANSAS RACING COMMISSION.

24 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

26 SECTION 1. Arkansas Code § 23-110-201(a), concerning the creation of
27 the Arkansas Racing Commission, is amended to read as follows:
28 (a) A commission consisting of seven (7) eleven (11) members, to be
29 known as the “Arkansas Racing Commission”, is created and established.

31 SECTION 2. Arkansas Code § 23-110-201(d), concerning membership of the
32 Arkansas Racing Commission, is amended to add an additional subdivision to
33 read as follows:
34 (4) Four (4) members shall be consumers who are not in the
35 business of or affiliated in any way with an Arkansas casino licensee or
36 casino vendor.

2 SECTION 3. Arkansas Code § 23-110-204, concerning the powers and
3 duties of the Arkansas Racing Commission, is amended to add additional
4 subsections to read as follows:
5 (f) The commission shall hear all matters related to casino gaming and
6 sports wagering, including without limitation the following:
7 (1) Rules related to casino gaming and sports wagering;
8 (2) Investigations into casino license holders;
9 (3) Investigations into allegations of illegal gambling; and
10 (4) Reviews of in-state tax collections derived from casino
11 gaming and sports wagering and comparisons with other states with legalized
12 casino gaming and sports wagering.
13 (g) If as a result of an investigation under subdivision (f)(3) of
14 this section the commission identifies an issue of illegal gambling, the
15 commission shall make a referral to the appropriate law enforcement agency.
16 (h) The commission shall report annually to the Legislative Council,
17 or if the General Assembly is in session, the Joint Budget Committee,
18 regarding matters that have come before the commission.
