22 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

24 SECTION 1. Arkansas Code § 17-80-403(a)(1), concerning the
25 establishment of a professional relationship within the Telemedicine Act, is
26 amended to read as follows:
27 (a)(1) Except as provided in subsection (d) of this section, a A
28 healthcare professional at a distant site shall not utilize telemedicine with
29 respect to a patient located in Arkansas unless a professional relationship
30 exists between the healthcare professional and the patient or the healthcare
31 professional otherwise meets the requirements of a professional relationship
32 as defined in § 17-80-402.

34 SECTION 2. Arkansas Code § 17-80-403, concerning the establishment of
35 a professional relationship within the Telemedicine Act, is amended to add an
36 additional subsection to read as follows:

1 (d) A professional relationship for physical therapy services shall
2 only be established if the healthcare professional conducts an in-person
3 examination of the patient.
