19 FINANCIAL SECURITY UNDER THE CUSTOMER
20 PROTECTIONS FOR NET-METERING CUSTOMERS
21 ACT; AND TO DECLARE AN EMERGENCY.

24 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

26 SECTION 1. Arkansas Code § 4-88-1103(3)(B), concerning a bond or other
27 financial security related to a net-metering facility or net-metering
28 service, as enacted by Acts 2023, No. 278, is amended to read as follows:
29 (B)(i) A bond or other acceptable financial security to
30 ensure proper maintenance of the net-metering facility and decommissioning of
31 the net-metering facility A single ten thousand dollar ($10,000) bond
32 obtained under § 17-25-404;
33 (ii) Commercial general liability insurance coverage
34 with a limit of at least one million dollars ($1,000,000); and
35 (iii) An applicable contractor's license issued by
36 the Contractors Licensing Board obtained prior to conducting business.

2 SECTION 2. EMERGENCY CLAUSE. It is found and determined by the
3 General Assembly of the State of Arkansas that a delay in the enactment of
4 this act may result in unreasonable delays and disruption in residential and
5 commercial construction projects and in the ability for consumers to take
6 advantage of solar investment; and that this act is immediately necessary for
7 the protection of Arkansas businesses and consumers. Therefore, an emergency
8 is declared to exist, and this act being immediately necessary for the
9 preservation of the public peace, health, and safety shall become effective
10 on:
11 (1) The date of its approval by the Governor;
12 (2) If the bill is neither approved nor vetoed by the Governor,
13 the expiration of the period of time during which the Governor may veto the
14 bill; or
15 (3) If the bill is vetoed by the Governor and the veto is
16 overridden, the date the last house overrides the veto.
