16                           PROTECTION ACT AND THE ARKANSAS UNBORN
17                           CHILD PROTECTION ACT TO ADD AN EXCEPTION
18                           FOR A PREGNANCY THAT IS THE RESULT OF
19                           INCEST.

22   BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

24            SECTION 1.      Arkansas Code § 5-61-304(a), concerning the prohibitions
25   under the Arkansas Human Life Protection Act, is amended to read as follows:
26            (a)   A person shall not purposely perform or attempt to perform an
27   abortion except:
28                  (1)      To to save the life of a pregnant woman in a medical
29   emergency; or
30                  (2)      When the pregnancy is the result of incest for which a
31   report has been filed with a law enforcement agency or prosecuting attorney's
32   office alleging the offense of incest, § 5-26-202, or the sexual assault of a
33   minor.

35            SECTION 2.      Arkansas Code § 5-61-404(a), concerning the prohibitions
36   under the Arkansas Unborn Child Protection Act, is amended to read as
