22 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

24 SECTION 1. Arkansas Code § 22-9-203, concerning the award procedure
25 for contracts for public improvements, is amended to add an additional
26 subsection to read as follows:
27 (n)(1) Except as provided in subdivision (n)(3) of this section, the
28 state, an agency of the state, a county, a municipality, a school district,
29 or other local taxing unit shall not enter into a contract with a contractor
30 that includes a project designed by an electrical engineering firm unless the
31 design requires allowance for a three-bid specification by three (3)
32 equivalent lighting agencies.
33 (2) As used in this subsection, "lighting agency" means an
34 entity that represents one (1) or more lighting manufacturers for sale
35 through electrical distribution houses.
36 (3) This subsection does not apply to a municipal electric
