Basic Change :

HB1633 amends § 27-53-202 concerning the amount of property damage that must be involved in an
accident to require the driver to notify law enforcement. Under current law, the driver of a vehicle
involved in an accident resulting in injury to or death of any person, or property damage to an apparent
extent of $1,000, is required to notify the nearest law enforcement agency immediately. HB1633 raises
the threshold of property damage required to $3,000.
Revenue Impact :
None.
Taxpayer Impact :
A driver involved in an accident that resulted in injury or death of any person or property damage to the
apparent extent of $3,000 would be required to notify law enforcement immediately.
Resources Required :
None.
Time Required :
Adequate time is provided for implementation.
Procedural Changes :
The Office of Driver Services would have to update procedures for placing an accident on a driver’s
record.

Legal Analysis :
HB1633 may benefit from an amendment to also raise the $1,000 threshold in § 27-19-501, which
requires the driver of a vehicle involved in an accident resulting in damage to property in excess of
$1,000 to report the accident to the Office of Driver Services of the Department of Finance and
Administration.
