21 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

23 SECTION 1. Arkansas Code ยง 7-7-301(a), concerning political party
24 filing fees for candidates seeking nomination by that party, is amended to
25 read as follows:
26 (a) A political party may impose a filing fee for candidates seeking
27 nomination by that party. The filing fee for county, municipal, and township
28 offices shall be fixed by the county committee, as authorized by the state
29 executive committee. For all other races, the filing fee shall be established
30 by the state executive committee. On or before noon of the last day of the
31 political party filing period, all candidates at primary elections of
32 political parties shall file an affidavit of eligibility and any pledge
33 required by such party and shall pay the party filing fees required by the
34 party, as follows:
35 (1)(A) Candidates for United States Senator, for United States
36 Representative, and for all state offices shall file the pledge and the

1 affidavit of eligibility and pay the party filing fees with the secretary of
2 the state committee of the political party or his or her designated agent.
3 (B) The filing fee set by the political party's state
4 executive committee shall be an amount no more than five percent (5%) of the
5 salary of the office for which the candidate is seeking nomination.
6 (C) The political party's state executive committee may
7 set the amount of the filing fee at zero ($0.00);
8 (2)(A) Candidates for district offices, including, but not
9 limited to, the offices of State Representative and State Senator, shall file
10 the pledge and affidavit of eligibility with the secretary of the state
11 committee of the political party or his or her designated agent and pay the
12 party filing fees with the secretary of the state committee of the political
13 party or his or her designated agent.
14 (B) The filing fee set by the political party's state
15 executive committee shall be an amount no more than three percent (3%) of the
16 salary of the office for which the candidate is seeking nomination.
17 (C) The political party's state executive committee may
18 set the amount of the filing fee at zero ($0.00); and
19 (3) All candidates for county, municipal, and township offices,
20 candidates for county committee member, and delegates to the county
21 convention shall file the pledge and the affidavit of eligibility and pay the
22 party filing fees with the secretary of the county committee of the political
23 party.
