19   BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

21           SECTION 1.       Arkansas Code Title 17, Chapter 92, Subchapter 4, is
22   amended to add an additional section to read as follows:
23           17-92-414.       Pharmacy permit ownership requirements.
24           (a)    In order to be issued a pharmacy permit under § 17-92-405, a
25   pharmacy shall submit to the Arkansas State Board of Pharmacy proof that the
26   applicant for the pharmacy permit is qualified to conduct the pharmacy and
27   is:
28                   (1)     A pharmacist licensed by the board and in good standing;
29                   (2)     A partnership in which each active member is a pharmacist
30   licensed by the board and in good standing;
31                   (3)     A corporation or association in which the majority stock is
32   owned by pharmacists licensed by the board and in good standing; or
33                   (4)     A limited liability company in which the majority membership
34   interests are owned by pharmacists licensed by the board and in good
35   standing, actively and regularly employed in and responsible for the
36   management, supervision, and operation of the pharmacy.

 1        (b)   This section does not apply to:
 2              (1)    A pharmacy with a pharmacy permit on or before the effective
 3   date of this act;
 4              (2)    A pharmacy chain that is headquartered in this state;
 5              (3)    A pharmacy that is within an institution such as a hospital;
 6   or
 7              (4)    A veterinary pharmacy or animal pharmacy.
