Basic Change :

SB375 modifies the use of certain funds deposited in the Commercial Driver's License Fund.
Under current law, § 19-6-459, five special revenues are deposited into the Commercial Driver License
Fund:
 Funds received under § 19-6-301(148): commercial driver license application fees, driver search
fees, and all fines collected under the Arkansas Uniform Commercial Driver License Act;
 Funds received under § 19-6-301(255): fees collected under § 27-14-602(c) which include fees for
commercial motor vehicles registered under the International Registration Plan;
 Funds received under § 19-6-301(266): motorboat duplicate title, lien filing, lien notation, and
certificate of title fees under the Arkansas Motorboat Registration and Titling Act;
 Funds received under § 19-6-301(267): motorboat certificate of title with beneficiary processing
fees and certificate of title application fees under the Arkansas Motorboat Registration and Titling
Act; and
 Funds received under § 19-6-301(269): expedited title processing fees collected under §
27-14-705(e)(2).
Current law restricts the use of fees received under §§ 19-6-301(255) and 19-6-301(269) to system
enhancements to the Arkansas Motor Carrier System. Fees received under § 19-6-301(148) are
permitted to be used to maintain the Arkansas Commercial Driver License Program "and for other
related purposes as required by the Secretary of the Department of Finance and Administration in
carrying out the functions, powers, and duties of the Revenue Division." SB375 adds corresponding
language to the code to allow the fees collected for the registration of semi-trucks and rush title fees to
be used for other needs within the Revenue Division that are related to the Arkansas Motor Carrier
System.

Resources Required :
The Arkansas Integrated Revenue System (AIRS) will need to be modified with a project cost of
$8,000.
Time Required :
Adequate time is provided for implementation.
