The bill amends the Arkansas Egg Marketing Act of 1969, specifically altering the number of hens a retailer can have to qualify for an exemption from the Act. Previously, retailers were allowed to sell eggs from producers with fewer than two hundred (200) hens. The new legislation increases this limit to seven hundred (700) hens, thereby expanding the number of small producers who can sell eggs without being subject to the full regulations of the Egg Marketing Act.
In addition to the change in the hen limit, the bill maintains existing requirements for retailers selling these eggs. These requirements include ensuring that the eggs are washed and clean, prepackaged and labeled as ungraded with the producer's name and address, using cartons that have had all brand markings obliterated, and keeping the eggs refrigerated at a temperature of forty-five degrees Fahrenheit (45°F) or below.
