22 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

24 SECTION 1. Arkansas Code § 16-64-120 is amended to read as follows:
25 16-64-120. Recovery of damages.
26 (a) Whenever damages are recoverable, the plaintiff may claim and
27 recover any rate of damages to which he or she may be entitled for the cause
28 of action established.
29 (b) Recovery of damages under subsection (a) of this section for
30 necessary medical care, necessary medical treatment, or necessary medical
31 services received includes only those costs actually paid by or on behalf of
32 the plaintiff or that remain unpaid and for which the plaintiff or any third
33 party is legally responsible.
