8 AN AMENDMENT TO THE ARKANSAS CONSTITUTION PROVIDING
9 THAT AN INDIVIDUAL SHALL NOT BE DENIED THE RIGHT TO
10 CONDUCT A TRANSACTION BASED UPON HIS OR HER PERSONAL
11 OPINIONS OR BELIEFS, INCLUDING WITHOUT LIMITATION HIS
12 OR HER RELIGIOUS BELIEFS.

16 AN AMENDMENT TO THE ARKANSAS CONSTITUTION
17 PROVIDING THAT AN INDIVIDUAL SHALL NOT BE
18 DENIED THE RIGHT TO CONDUCT A TRANSACTION
19 BASED UPON HIS OR HER PERSONAL OPINIONS
20 OR BELIEFS.

23 BE IT RESOLVED BY THE SENATE OF THE NINETY-THIRD GENERAL ASSEMBLY OF THE
24 STATE OF ARKANSAS, AND BY THE HOUSE OF REPRESENTATIVES, A MAJORITY OF ALL
25 MEMBERS ELECTED TO EACH HOUSE AGREEING THERETO:

27 THAT the following is proposed as an amendment to the Constitution of
28 the State of Arkansas, and upon being submitted to the electors of the state
29 for approval or rejection at the next general election for Representatives
30 and Senators, if a majority of the electors voting thereon at the election
31 adopt the amendment, the amendment shall become a part of the Constitution of
32 the State of Arkansas, to wit:

34 SECTION 1. Arkansas Constitution, Article 2, is amended to add an
35 additional section to read as follows:
36 ยง 30. Right to conduct transactions.

1 (a) As used in this section, "transaction" means engaging in a sale,
2 purchase, or payment for food, medicine, clothing, shelter, or other goods or
3 services normally used for personal, family, or household purposes through:
4 (1) A cash sale, purchase, or payment;
5 (2) An electronic sale, purchase, or payment, including without
6 limitation the use of a credit card; or
7 (3) Another method of engaging in a sale, purchase, or payment
8 for a good or service normally used for personal, family, or household
9 purposes.
10 (b) An individual shall not be denied the right to conduct a
11 transaction based upon his or her personal opinions or beliefs, including
12 without limitation his or her religious beliefs.

14 SECTION 2. EFFECTIVE DATE. This amendment is effective on and after
15 November 6, 2024.

17 SECTION 3. BALLOT TITLE AND POPULAR NAME. When this proposed
18 amendment is submitted to the electors of this state on the general election
19 ballot:
20 (1) The title of this Joint Resolution shall be the ballot
21 title; and
22 (2) The popular name shall be "An Amendment to the Arkansas
23 Constitution Providing that an Individual Shall Not Be Denied the Right to
24 Conduct a Transaction Based Upon His or Her Personal Opinions or Beliefs,
25 Including Without Limitation His or Her Religious Beliefs".
