20 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

22 SECTION 1. REGULAR SALARIES - OPERATIONS. There is hereby established
23 for the Office of the Lieutenant Governor for the 2023-2024 fiscal year, the
24 following maximum number of regular employees.

3 Office of the Lieutenant Governor for the fiscal year ending June 30, 2024,

18 SECTION 3. SPECIAL LANGUAGE. CODE AMENDMENT. Arkansas Code Title 25,
19 Chapter 16, Subchapter 3, is amended to add an additional section to codify
20 special language in appropriation acts to read as follows:
21 25-16-303. Appropriation transfer.
22 The office of the Lieutenant Governor may transfer an appropriation
23 from any line item authorized in the operations appropriation of the office
24 of the Lieutenant Governor to any other line item authorized in the
25 operations appropriation of the office of the Lieutenant Governor if:
26 (1) The Chief Fiscal Officer of the State approves the transfer
27 of the appropriation; and
28 (2) The transfer is reviewed by the Legislative Council or, if
29 the General Assembly is in session, the Joint Budget Committee.

31 SECTION 4. SPECIAL LANGUAGE. CODE AMENDMENT. Arkansas Code § 12-8-
32 108(a), concerning the duties of the Division of Arkansas State Police, is
33 amended to read as follows:
34 (a) The Division of Arkansas State Police shall be responsible for the
35 safety and security of the:
36 (1) Governor and his or her family;

1 (2) Lieutenant Governor and his or her family;
2 (3) Governor's Mansion and mansion grounds; and
3 (4) (3) State Capitol Building and State Capitol grounds.

5 SECTION 5. SPECIAL LANGUAGE — CODE AMENDMENT. Arkansas Code Title 25,
6 Chapter 16, Subchapter 3, is amended to add an additional section to read as
7 follows:
8 25-16-303. Security personnel.
9 (a) The Lieutenant Governor may hire and employ in the manner
10 described under this section security personnel to maintain peaceful order
11 and provide protection to the Lieutenant Governor as the Lieutenant Governor
12 carries out his or her official duties.
13 (b)(1) Personnel designated by the Lieutenant Governor as security
14 personnel are considered full-time law enforcement officers with the full
15 range of responsibilities and authority as are afforded to a law enforcement
16 officer certified by the Arkansas Commission on Law Enforcement Standards and
17 Training.
18 (2) The Lieutenant Governor may set his or her own training and
19 qualification standards for security personnel employed by the Lieutenant
20 Governor.
21 (3) The commission shall permit security personnel employed by
22 the Lieutenant Governor access to all law enforcement training generally
23 available to other law enforcement personnel and shall make the law
24 enforcement certification process available to security personnel employed by
25 the Lieutenant Governor.
26 (c) Security personnel employed by
27 the Lieutenant Governor shall have statewide jurisdiction while the security
28 personnel are acting within the scope of their employment.

30 SECTION 6. COMPLIANCE WITH OTHER LAWS. Disbursement of funds
31 authorized by this act shall be limited to the appropriation for such agency
32 and funds made available by law for the support of such appropriations; and
33 the restrictions of the State Procurement Law, the General Accounting and
34 Budgetary Procedures Law, the Revenue Stabilization Law, the Regular Salary
35 Procedures and Restrictions Act, or their successors, and other fiscal
36 control laws of this State, where applicable, and regulations promulgated by

1 the Department of Finance and Administration, as authorized by law, shall be
2 strictly complied with in disbursement of said funds.

4 SECTION 7. LEGISLATIVE INTENT. It is the intent of the General
5 Assembly that any funds disbursed under the authority of the appropriations
6 contained in this act shall be in compliance with the stated reasons for
7 which this act was adopted, as evidenced by the Agency Requests, Executive
8 Recommendations and Legislative Recommendations contained in the budget
9 manuals prepared by the Department of Finance and Administration, letters, or
10 summarized oral testimony in the official minutes of the Arkansas Legislative
11 Council or Joint Budget Committee which relate to its passage and adoption.

13 SECTION 8. EMERGENCY CLAUSE. It is found and determined by the General
14 Assembly, that the Constitution of the State of Arkansas prohibits the
15 appropriation of funds for more than a one (1) year period; that the
16 effectiveness of this Act on July 1, 2023 is essential to the operation of
17 the agency for which the appropriations in this Act are provided, and that in
18 the event of an extension of the legislative session, the delay in the
19 effective date of this Act beyond July 1, 2023 could work irreparable harm
20 upon the proper administration and provision of essential governmental
21 programs. Therefore, an emergency is hereby declared to exist and this Act
22 being necessary for the immediate preservation of the public peace, health
23 and safety shall be in full force and effect from and after July 1, 2023.
