The "Right to Start Pilot Program for Healthcare Portability Act" aims to establish a program that provides health insurance portability and tax support for entrepreneurs starting small businesses in Arkansas. The Insurance Commissioner is tasked with developing, implementing, and administering this program, which will offer statewide group health insurance benefits and tax assistance for eligible entrepreneurs. The act defines an entrepreneur as an individual meeting specific criteria set by the commissioner and outlines the application process for health insurance benefits and tax support, which is limited to the first three years of the business's formation.
Additionally, the act mandates that participating entrepreneurs file annual reports detailing their business status, employee count, claims filed, and the economic impact of the tax support received. The Secretary of State is responsible for notifying entrepreneurs about the program when they file for business formation. The Insurance Commissioner is also required to promulgate necessary rules for the program's implementation, with initial rules to be filed by January 1, 2024, or as soon as practicable thereafter if prior approval is pending.
