18 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

20 SECTION 1. Arkansas Code 27-16-811(a), concerning the exemption from
21 disclosure of a residential address on a driver's license under the address
22 confidentiality program, is amended to read as follows:
23 (a) As used in this section,:
24 (1) "Domestic violence" means:
25 (A) Physical harm, bodily harm causing injury, or an
26 assault against a person caused by:
27 (i) A family or household member; or
28 (ii) Another person with whom the victim is in a
29 dating relationship;
30 (B) Mental or emotional harm to a person caused by:
31 (i) A family or household member; or
32 (ii) Another person with whom the victim is in a
33 dating relationship; or
34 (C) Sexual abuse caused by:
35 (i) A family or household member; or
36 (ii) Another person with whom the victim is in a

1 dating relationship; and
2 (2) licensee "Licensee" means a person who is applying for,
3 renewing, or requesting a change to his or her driver's license issued or to
4 be issued under this chapter and who is:
5 (1)(A) The victim of domestic violence; or
6 (2)(B) The dependent of a victim of domestic violence.

8 SECTION 2. Arkansas Code 27-16-811(c)(3)(A), concerning the
9 information provided to the Department of Finance and Administration by a
10 licensee, is amended to read as follows:
11 (3)(A) The department shall only disclose the residence address
12 to a person who:
13 (i) Presents a current and valid court order from a
14 court in this state finding a compelling reason for access to the residence
15 address in an affidavit;
16 (ii) Presents valid identification to the
17 department; and
18 (iii) Is not a person who has been convicted of
19 domestic violence against whom the order of protection has been entered or
20 who is related by blood or marriage to the person against whom the order of
21 protection has been entered.
