20 AND TO AMEND THE AMOUNT OF THE ABANDONED
21 PESTICIDE DISPOSAL FEE.

24 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

26 SECTION 1. Arkansas Code 8-7-1206(a)(1), concerning the Abandoned
27 Pesticide Disposal Fee per registered pesticide, is amended to read as
28 follows:
29 (a)(1) Moneys received into the Abandoned Agricultural Pesticide and
30 Plant Regulator Disposal Trust Fund shall be from gifts, grants, or funds
31 from entities other than the State Plant Board and from a fee of fifty
32 dollars ($50.00) not to exceed one hundred dollars ($100) established by rule
33 by the State Plant Board per registered pesticide per registrant per year
34 levied by the State Plant Board for the specific purpose of funding the
35 disposal of abandoned pesticides.

1 SECTION 2. Arkansas Code 8-7-1206(a)(5), concerning utilization of
2 the moneys within the Abandoned Agricultural Pesticide and Plant Regulator
3 Disposal Trust Fund, is amended to read as follows:
4 (5) Moneys received into the fund shall be utilized by the State
5 Plant Board Department of Agriculture, as authorized by the Abandoned
6 Pesticide Advisory Board, to pay for projects and other activities relating
7 to the collection and disposal of abandoned pesticides and for administrative
8 support.

10 SECTION 3. Arkansas Code 8-7-1206(b), concerning administration of
11 the program relating to the collection and disposal of abandoned pesticides,
12 is amended to read as follows:
13 (b)(1) The State Plant Board department shall administer the program
14 relating to the collection and disposal of abandoned pesticides, as
15 authorized by the Abandoned Pesticide Advisory Board.
16 (2) The duties of the State Plant Board department shall
17 include:
18 (A) Developing and issuing requests for proposals from
19 contractors to collect and dispose of abandoned pesticides;
20 (B) Contracting for the collection and disposal of
21 abandoned pesticides; and
22 (C) Paying contractors for services relating to the
23 collection and disposal of abandoned pesticides.
