 9                   AN ACT TO CREATE THE SMALL TOWN ECONOMIC DEVELOPMENT
10                   ACT; TO AMEND THE EXEMPTIONS TO THE LICENSING
11                   REQUIREMENTS FOR ARCHITECTS; AND FOR OTHER PURPOSES.

16                           DEVELOPMENT ACT.

19   BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:
20
21          SECTION 1.       DO NOT CODIFY.       Title.
22          This act shall be known and may be cited as the "Small Town Economic
23   Development Act".
24
25          SECTION 2.       Arkansas Code  17-15-302(a)(4)(C), concerning the
26   exemptions to the licensing requirements for architects, is amended to read
27   as follows:
28                           (C)   Buildings whose total cumulative and fair market value
29   to complete, not including site, does not exceed one hundred thousand dollars
30   ($100,000) two hundred fifty thousand dollars ($250,000); and

32          SECTION 3.       Arkansas Code  17-15-302(b) and (c), concerning the
33   exemptions to the licensing requirements for architects, are amended to read
34   as follows:
35          (b)(1)       The terms of this chapter shall not apply to:
36                           (A)   Any public school district exempted from the

 1   provisions of this chapter; or
 2                       (B)   Every public school district embracing a city with a
 3   population in excess of thirty thousand (30,000) which maintains a full-time
 4   superintendent of buildings with engineering and architectural experience.
 5               (2)    This exception shall only apply:
 6                       (A)   If the total cumulative and fair market value to
 7   complete the repair and maintenance of buildings already constructed and
 8   alterations thereof does not exceed the sum of one hundred thousand dollars
 9   ($100,000) two hundred fifty thousand dollars ($250,000); and
10                       (B)   If the total cumulative and fair market value to
11   complete the new structures will not exceed the sum of one hundred thousand
12   dollars ($100,000) two hundred fifty thousand dollars ($250,000).
13         (c)   The provisions of this chapter shall not apply to any public
14   school district, place of assembly, daycare, church, or building not more
15   than one (1) story high where:
16               (1)    The total cumulative and fair market value to complete the
17   building, alteration, or structure does not exceed the sum of one hundred
18   thousand dollars ($100,000) two hundred fifty thousand dollars ($250,000);
19   and
20               (2)    The plans are approved by the State Fire Marshal.

22         SECTION 4.    Arkansas Code  22-9-101(b)(2), concerning exceptions to
23   the required observation of public works by registered professionals, is
24   amended to read as follows:
25               (2)    For an architectural project does not exceed one hundred
26   thousand dollars ($100,000) two hundred fifty thousand dollars ($250,000).

28         SECTION 5.    DO NOT CODIFY.    TEMPORARY LANGUAGE AND SUSPENSION OF
29   CURRENT LAW.    Review and expiration.
30         (a)   The effect of this act shall be reviewed by the House Committee on
31   City, County, and Local Affairs and the Senate Committee on City, County, and
32   Local Affairs on or before October 10, 2022, to determine if the licensing
33   requirements for architects and the exemptions for buildings where the total
34   cumulative and fair market value exceeds a certain dollar amount should
35   either:
36               (1)    Remain at two hundred fifty thousand dollars ($250,000); or

 1              (2)    Revert to one hundred thousand dollars ($100,000).
 2        (b)   This act is cumulative of existing laws and shall not repeal but
 3   merely suspend any law in conflict with this act.
 4        (c)   On and after December 31, 2023, the provisions of law suspended by
 5   this act shall be effective.
 6        (d)   The expiration of this act shall not affect rights acquired under
 7   it or affect lawsuits then pending.
