This bill authorizes the Judge of Probate of Walker County to appoint temporary judges of probate under specific circumstances, such as calendar congestion or complex issues. The appointed temporary judges must be qualified electors of Walker County who are licensed to practice law in Alabama. The bill stipulates that no temporary appointment can exceed 90 days, although successive appointments may be made, with a maximum service limit of 200 days per individual in a calendar year. Temporary judges will have the same jurisdiction and authority as the elected judge of probate, and their decisions will carry the same legal weight.

Additionally, the bill clarifies that neither the elected judge of probate nor their surety will be liable for the actions or decisions made by temporary judges. Compensation for temporary judges is set at $50 per hearing, to be paid from the discretionary funds of the judge of probate, with no additional compensation for those who are already employees of the probate court. The act is set to take effect on June 1, 2026.
