The bill amends Section 36-22-64 of the Code of Alabama 1975 to allow qualifying sheriffs to participate in both the supernumerary sheriff program and the Employees' Retirement System, provided they qualify based on separate years of service. The new legal language specifies that no individual may participate in both programs based on the same service, but those who meet the criteria for both programs independently can do so. Additionally, if a sheriff is eligible for retirement benefits under other retirement plans, they must elect which plans to participate in within 60 days of becoming eligible for payments.

The bill also includes several deletions and insertions to clarify the language regarding participation in retirement plans. Notably, it replaces the term "plan" with "plans" and "act" with "acts," and changes references from "person's" to "individual's." The act is set to become effective on October 1, 2026.
