The bill amends Section 11-43-2 of the Code of Alabama 1975 to clarify the legislative functions of mayors in municipalities, particularly those with populations of 12,000 or more. It introduces new provisions allowing mayors in cities with an even number of council seats to vote in the event of a tie, provided that the local governing body has adopted a resolution authorizing this action. Additionally, the bill specifies that in cities with populations under 12,000, the mayor presides over the council and may vote on any question, except in the case of a tie, where the mayor is required to vote.

Furthermore, the bill allows cities with populations between 12,000 and 25,000 to opt to operate under the legislative framework applicable to smaller municipalities, provided they adopt an ordinance to that effect at least six months before the next general election. The bill also includes a provision that waives the six-month requirement if necessary to comply with mandates from the U.S. Justice Department or court orders related to the Voting Rights Act. The act is set to take effect on October 1, 2026.
