The bill amends Section 36-27D-1 of the Code of Alabama 1975 to address public corruption convictions among public servants. Key changes include the forfeiture of retirement benefits for individuals found guilty of felony offenses related to their public service, with the forfeited retirement contributions being redirected to pay restitution to the affected public agency or entity. Additionally, if a retired member is convicted, their retirement benefits will be suspended, and any remaining contributions will also be used for restitution, with any surplus refunded to the individual. The bill also updates the notification process, requiring prosecutors to inform relevant retirement boards of convictions, and clarifies that failure to provide notice does not affect forfeiture or restitution obligations.
Furthermore, the bill stipulates that public officials or employees under investigation for felony offenses may use public funds for their legal defense until they are indicted. However, once indicted, they are prohibited from using public funds for their defense. If a public official or employee is placed on paid leave during the investigation and is later convicted, they must repay all compensation received during that period. The act is set to take effect on October 1, 2026.
