This bill establishes a service of process fee specifically for the Talladega County Sheriff's Office, which will be applicable for the service or attempted service of certain documents related to matters pending in courts outside the State of Alabama. The fee structure includes a charge of fifty dollars ($50) for general service and one hundred dollars ($100) for service to inmates at the Federal Correctional Institution in Talladega. The collection of these fees will be managed by the clerk of the court or a designated individual, who will remit the fees directly to the sheriff for deposit into a newly created Sheriff's Official Account.
The bill also stipulates that the funds in the Sheriff's Official Account will be separate from the sheriff's budget and will not replace any existing budgeted funds or income sources. The sheriff will have discretion over the expenditure of these funds for law enforcement purposes. Additionally, certain entities, including the district attorney, law enforcement, grand juries, and Talladega County itself, are exempt from paying these fees. The act is set to take effect on October 1, 2025.
