Under existing law, unauthorized entry of a critical infrastructure facility is a Class A misdemeanor. This bill would provide that unauthorized entry of a criminal infrastructure facility is a Class D felony. Under existing law, if a person injures, removes, destroys, or breaks critical infrastructure property, or otherwise interrupts or interferes with the operations of a criminal infrastructure asset, during the commission of the crime of unauthorized entry of a critical infrastructure facility, the person is guilty of a Class C felony. This bill would provide that a person who injures, removes, destroys, or breaks critical infrastructure property, or otherwise interrupts or interferes with the operations of a critical infrastructure asset, or attempts to interrupt or interfere with the operations of a critical infrastructure asset in any manner, during the commission of the crime of unauthorized entry of a criminal infrastructure facility, is guilty of a Class B felony. Under existing law, a person commits the crime of criminal tampering in the first degree if he or she intentionally causes substantial interruption or impairment of a service rendered to the public by a utility having no right to do so or any reasonable ground to believe that he or she has such a right. This bill would provide that a person commits the crime of criminal tampering in the first degree if he or she intentionally causes or attempts to cause substantial interruption or impairment of a service rendered to the public by a utility having no right to do so or any reasonable ground to believe that he or she has such a right.
