This bill establishes new fees in Elmore County, specifically a court cost and a booking fee, both set at $100, to be assessed in cases processed through the circuit court and for defendants booked into the county jail, respectively. The court cost will increase by $5 annually starting January 1 each year, and the same applies to the booking fee. These fees are in addition to any other existing court costs and cannot be waived unless all associated fees are also waived. The clerk of the court is responsible for collecting these fees and must publish notice of any adjustments.

The proceeds from both the court cost and booking fee will be deposited into the Enhance Elmore Fund. Initially, the county commission will allocate these funds for the debt service related to the expansion and renovation of the judicial complex properties. Once the debt is satisfied, the funds will then be used for the maintenance, operations, and upgrades of the facilities on the judicial complex parcel. The act is set to take effect on January 1, 2026.
