The proposed bill adds two new sections, 22-20-3.3 and 22-20-3.4, to the Code of Alabama 1975, focusing on postpartum depression. Section 22-20-3.3 mandates the Alabama Department of Public Health to create and distribute educational materials regarding postpartum depression to health care professionals and parents. These materials will include information on the signs and symptoms of postpartum depression and guidance on when to seek help. The Department is also tasked with periodically reviewing these materials for accuracy and effectiveness, and hospitals are permitted to provide this information to parents upon discharge. Importantly, the bill includes a provision that protects hospitals and health care professionals from legal liability related to the dissemination of this information.
Section 22-20-3.4 requires that physicians and licensed health care professionals assess birth mothers for postpartum depression during postnatal or pediatric care. While they are encouraged to use their professional judgment in recommending treatment, the section clarifies that it does not establish a standard of care or alter existing medical liability laws. The bill is set to take effect on October 1, 2025.
