The bill mandates that all Internet-enabled devices, specifically tablets and smartphones manufactured after June 1, 2025, must include a filter designed to prevent access to obscene material. Key provisions include requiring users to provide their age during device activation, automatically enabling the filter for minors, and allowing users to establish a password for the filter. Manufacturers are held liable if a device activated in Alabama does not comply with these requirements and a minor accesses obscene material. However, manufacturers can avoid liability if they demonstrate a good faith effort to comply with the filter requirements.
Additionally, the bill grants the Attorney General the authority to enforce compliance, including the ability to issue civil penalties of up to $5,000 per violation, with a maximum aggregate penalty of $50,000. The Attorney General can also seek to revoke a manufacturer's business license for repeated violations. The act does not apply to devices manufactured before the specified date or to video game consoles, and it will take effect on October 1, 2025.
