The bill SB110 amends Sections 32-9-20 and 32-9-31 of the Code of Alabama 1975 to create exceptions to weight limits for specific types of trucks, including dump trucks, concrete mixing trucks, and fuel oil trucks. The new legal language allows these trucks to bypass certain axle spacing requirements as long as they do not exceed a weight of 20,000 pounds per axle, plus an allowable load tolerance. Additionally, trucks delivering asphalt plant mix and concrete mixing trucks operating within 50 miles of their home base are exempt from certain weight requirements if they stay within the maximum allowable gross weight. The bill also updates the authority responsible for designating bridges that cannot carry certain loads from the "Transportation Director" to the "Director of Transportation."
Furthermore, the bill revises the procedures for using portable scales to enforce weight limits, allowing for the simultaneous weighing of axles and providing options for operators to demonstrate compliance by adjusting their loads. It includes provisions for the detention of up to five vehicles at a time during enforcement and exempts agricultural vehicles from certain weight requirements. The bill also allows vehicles equipped with auxiliary power units and natural gas-fueled vehicles to exceed weight limits under specific conditions. All scales used for weighing must be approved by the weights and measures division of the Department of Agriculture and Industries, and the act is set to take effect on October 1, 2025.
