The bill amends Section 6-5-332 of the Code of Alabama 1975 to limit civil liability for individuals affiliated with or members of community emergency response teams (CERT) who have completed federally recognized training. The new language specifies that these individuals, along with various other emergency responders, will not be liable for civil damages when they provide first aid or emergency care in good faith at the scene of an accident or disaster. The bill replaces previous references to CERT members certified by the Federal Emergency Management Agency (FEMA) with a broader definition that includes those who have completed recognized training.
Additionally, the bill clarifies that immunity from civil liability extends to various professionals, including engineers and architects, who participate in emergency response activities under the direction of a community emergency response team. The immunity applies to acts performed without compensation and is effective for 90 days following the declaration of an emergency. The act is set to take effect on October 1, 2025.
