The bill establishes regulations regarding the transfer of unexpired manufacturer's warranties for heating, ventilation, and air-conditioning (HVAC) systems when residential real property is sold. Effective October 1, 2025, if a residential property that includes an HVAC system is conveyed to a new owner, any existing manufacturer's warranty on that system will automatically transfer to the new owner. The warranty will continue to be valid as if the new owner were the original purchaser, and the warrantor is prohibited from charging a fee for this transfer. However, the transfer of the warranty does not extend its remaining term.

Additionally, the bill specifies that the provisions apply only if the sale occurs after October 1, 2025, and the warranty is still in effect at the time of the sale. If a warranty agreement was entered into or renewed before this date, it will be governed by the previous law. The bill includes new legal language to clarify these terms and conditions, while no existing legal language is deleted. The act is set to take effect on October 1, 2025.
