The bill amends Sections 34-25-2, 34-25-3, and 34-25-20 of the Code of Alabama 1975, concerning the Polygraph Examiners Board. It introduces a definition for "polygraph device," which is an instrument that records a subject's cardiovascular pattern, respiratory pattern, and galvanic skin response, and clarifies that this term does not include equipment or devices used for computer voice stress analysis. The bill also includes nonsubstantive, technical revisions to update the existing code language to current style, such as changing "shall" to a present tense, "chairman" to "chair," and removing gender-specific language by adding "or herself" after "himself."

The bill specifies that during a polygraph examination, a polygraph device must be used, and it prohibits the use of any device that does not meet the minimum requirements as defined in Section 34-25-2. Additionally, it makes it unlawful for any person, including city, county, or state employees, to administer polygraph examinations or to hold themselves out as a polygraph examiner without a license approved and issued by the board, and to use any polygraph device that does not meet the requirements of Section 34-25-2. The act is set to become effective immediately upon its enactment.
