This bill pertains to Cullman County and outlines the authority and responsibilities of the sheriff regarding abandoned and stolen firearms. It defines "firearm" as per Section 13A-8-1 of the Code of Alabama 1975 and mandates that the sheriff maintain a separate permanent record of all such firearms not subject to general law disposition. This record must include a description of the firearm, the recovery date, serial or identifying number, and the recovery location.
The bill allows the sheriff to sell or destroy a firearm under certain conditions: the firearm must be recorded, held by the sheriff for at least six months, and not claimed by the owner. Sales or trades can only be made to gun dealers with an active business license in Alabama for at least one year. The sheriff must notify gun dealers about firearms available for sale or trade. Proceeds from sales, after covering expenses, will be distributed with 70% going to the sheriff's office and 30% to the district attorney's office. The sheriff is also permitted to establish procedures for destroying firearms and may use department funds for this purpose. The act will become effective on October 1, 2024. There is an insertion indicating that the Senate passed the act on May 2, 2024.
