The bill amends Section 3-1-28 of the Code of Alabama 1975, concerning the disposal of dead animals. The amendment changes the language to specify that owners or custodians of animals that die or are killed, other than those slaughtered for food, must dispose of the animals' bodies within 24 hours. The methods of disposal have been updated to include burning, burying at least two feet below the ground, or disposing of the bodies in accordance with Alabama Department of Agriculture and Industries rules. The bill removes the specific requirement to burn hogs that die from cholera or any other disease, which was previously mandated.
Additionally, the bill updates the language to be more inclusive, replacing "which" with "that," "their" with "his or her," and "person" with "individual." It also clarifies that no animal should be disposed of near a residence in a manner that creates a nuisance. Violators of this section will be guilty of a misdemeanor and subject to a fine of not more than fifty dollars ($50.00). The act is set to become effective on October 1, 2024.
