The bill amends Section 33-4A-13 of the Code of Alabama 1975, which pertains to the rulemaking authority of the State Pilotage Commission in Class 2 municipalities. The new language grants the commission the ability to make necessary rules for the piloting of ships and watercraft into and out of harbors or seaports, specifically in the Port of Mobile, until they are berthed at the docking facility or past the Mobile Entrance Lighted Buoy. Additionally, the bill stipulates that any maritime data produced by foreign states or companies must receive express preapproval from the commission for official use in pilotage.
Furthermore, the bill modifies the commission's authority regarding the physical and mental fitness of active bar pilots. It allows the commission to require evidence of fitness at any time and to adopt rules concerning the capacity and fitness of active bar pilots. The language changes include replacing "shall have the power and authority" with "may" and removing the phrase "and regulations" in several instances. The act is set to become effective on October 1, 2024.
