The proposed amendment to the Constitution of Alabama of 2022 seeks to redefine the jurisdiction of the Tuscaloosa City Board of Education. Effective for the school year beginning in August 2025, the amendment stipulates that the Tuscaloosa City Board of Education will only have authority over territories within the corporate limits of the City of Tuscaloosa. Any territory outside these limits, which was previously under the jurisdiction of the Tuscaloosa City Board, will instead fall under the control of the Tuscaloosa County Board of Education or any applicable city board of education.

Additionally, the amendment includes provisions regarding ad valorem tax revenues. For the tax year starting October 1, 2024, one-fourth of the revenue from ad valorem taxes collected in areas outside the corporate limits of Tuscaloosa will be allocated to the Tuscaloosa County Board of Education. Furthermore, for the tax year beginning October 1, 2025, existing ad valorem taxes on properties outside the city limits will continue to be levied and collected as per current terms, with the funds designated solely for educational purposes. The amendment also allows for transitional attendance agreements between the two education boards, ensuring a smooth transition in governance.
