The bill amends Section 13A-10-241 of the Code of Alabama 1975, which pertains to the crime of making a terrorist threat in the first degree. The amendment includes an insertion that expands the list of potential victims of such threats to include elected public officials or their staff. This addition is specified in a new subsection (4) under the conditions that elevate a threat to a terrorist threat in the first degree. The existing conditions for a threat to qualify as a terrorist threat include causing the evacuation of property, disrupting a school, church, or government activity, or being made with intent to retaliate against someone involved in legal or administrative proceedings.
The bill also states that making a terrorist threat in the first degree remains a Class C felony. Furthermore, the bill acknowledges that while it may require new or increased expenditure of local funds, it is exempt from further requirements under Section 111.05 of the Constitution of Alabama of 2022 because it defines a new crime or amends the definition of an existing crime. The act is set to become effective on October 1, 2024. The document includes signatures from the President and Presiding Officer of the Senate and the Speaker of the House of Representatives, and it is certified by the Senate Secretary that the act originated and passed in the Senate.
