The bill amends Section 17-9-10 of the Code of Alabama 1975 to establish new procedures for voters who have changed their domicile but have not updated their voter registration records before an election. The new legal language specifies that voters must vote in the precinct of their current domicile, and if they attempt to vote in a different location, their vote will be rejected unless they are casting a provisional ballot. If a voter’s current domicile is within the same voting place as their registered address, election officials can provide a form to update their registration and allow them to cast a regular ballot. Conversely, if the current domicile is outside the precinct, officials will inform the voter of their correct voting place and may provide assistance to minimize wait times.
Additionally, the bill allows for provisional ballots to be cast at the correct voting place, which will enable voters to update their registration immediately. Election officials are granted the authority to inquire about discrepancies in a voter's domicile based on various criteria, including the voter's own statements or identification that shows a different address. The bill also includes provisions for election officials to file challenge statements if they believe a voter is not qualified to vote at a specific location. This act is set to take effect on October 1, 2024.
