This bill aims to prohibit individuals from possessing firearms that are modified or equipped with parts that can convert them into machine guns. The term "machine gun" is defined according to the federal statute 26 U.S.C. ยง 5845. Specifically, the bill makes it illegal for a person to knowingly own or have in their possession, control, care, or custody a pistol that has parts designed or intended to convert the firearm into a machine gun attached to it. Violating this provision would be considered a Class C felony.
However, the bill outlines exceptions to this prohibition. It does not apply to state or local law enforcement officers acting in their official capacity, nor does it apply to individuals who own or possess firearms or parts that are registered in the National Firearms Registration and Transfer Record maintained by the Bureau of Alcohol, Tobacco, Firearms, and Explosives, or to those not subject to registration. Additionally, the bill exempts parts or devices intended to increase the rate of fire of a pistol but do not allow the pistol to fire more than one shot per trigger pull without manual reloading. The act is set to become effective on October 1, 2024.
