The bill amends Section 36-27-8.2 of the Code of Alabama 1975, which pertains to the Employees' Retirement System. It allows certain retired state police officers to perform duties as school resource officers or correctional officers without their retirement allowance being suspended. The bill introduces changes to the existing law by replacing the term "person" with "individual" and by specifying that retired individuals with the appropriate Alabama Peace Officers' Standards and Training certification, who were classified as law enforcement officers or state policemen prior to retirement, can earn up to $52,000 per year without suspension of their retirement allowance. This provision is set to expire on December 31, 2026.

The bill also includes provisions for elected officials who are retired from the Employees' Retirement System, allowing them to serve for compensation in an elected public office without suspension of retirement benefits, provided they do not exceed the annual earning limits and do not accrue additional benefits under the retirement system. The bill places the responsibility for compliance with these provisions upon the employing authority and requires retirees to certify any necessary information to their employers. Additionally, retirees must notify the Employees' Retirement System and the employing authority within 30 days of any postretirement employment that exceeds the stipulated conditions. The act is set to become effective on August 1, 2023, following its passage and approval by the Governor, or its otherwise becoming law.
