The bill amends Section 36-27-8.2 of the Code of Alabama 1975 to allow certain retired state police officers to serve as school resource officers or correctional officers without losing their retirement benefits. Specifically, it permits individuals who are retired under the Employees' Retirement System and hold the necessary Alabama Peace Officers' Standards and Training certification to work in these roles, provided their annual compensation does not exceed $52,000. The bill also clarifies that these individuals must have been classified as law enforcement officers or state policemen prior to retirement.
Additionally, the bill makes several changes to the language used in the existing law, replacing "person" with "individual" and modifying the criteria for retired individuals to perform duties without suspension of their retirement allowance. It also specifies that the responsibility for compliance with the provisions of this section lies with the employing authority, and retirees must notify their employer of any post-retirement employment. The act is set to take effect on August 1, 2023, following its passage and approval by the Governor.
