The bill amends Section 45-2-80.130 of the Code of Alabama 1975 to establish the Baldwin County Mental Health Court Fund. It introduces a new court cost of ten dollars ($10) that will be assessed on each criminal case filed in the circuit and district courts of Baldwin County, excluding juvenile and family court cases. The collected costs will be paid to the Baldwin County Commission, which is tasked with creating the Mental Health Court Fund.

Additionally, the presiding circuit judge in Baldwin County will manage this fund, in consultation with the judge assigned to the mental health diversionary program and the district attorney. The proceeds from the fund will be allocated for the creation, implementation, and ongoing administration of a mental health diversionary program, referred to as the "mental health court." The bill also specifies that these fees cannot be waived unless all other associated fees and costs are waived. The act will take effect on the first day of the third month following its passage and approval by the Governor.
